Kenneth Berlin heads the law firm of Skadden, Arps, Slate, Meagher & Flom's Environmental and Climate Change practices. Berlin has been involved in a wide range of environmental issues since 1979, when he was Section Chief in the Environment and Natural Resources Division of the U.S. Department of Justice. He also was Chairman of the Board of the Environmental Law Institute from 2003-2005. He is one of two U.S. lawyers listed in the first tier of climate change lawyers in Chambers Global and one of three lawyers listed in the first tier of national climate change lawyers in Chambers U.S. Skadden's Climate Change practice was chosen in a joint survey by Environmental Finance and Carbon Finance magazines as the top law firm in the U.S. Mandatory Climate Markets and as the runner-up in the Voluntary Carbon Markets categories.
Berlin has extensive experience in and advising clients on climate change issues, such as providing compliance and disclosure advice, drafting and negotiating GHG trading contracts, developing innovative ideas for programs in the residential and commercial carbon efficiency markets, entering the avoided deforestation market, and complying with climate change regulations and environmental impact analysis in developing energy and other projects. Berlin represents an electric power generating company in defending an investigation under New York State's Martin Act regarding climate change disclosure.
Berlin is a frequent speaker at conferences on climate change issues. His topics have included carbon capture and sequestration issues, the business of climate change, energy security and climate change, and climate change legislation and litigation. During the 2008 political campaign, Mr Berlin represented the Obama campaign as a surrogate speaker on climate change issues at 19 events, mostly debates with representatives of Senator McCain. Mr Berlin was on the Obama EPA Transition team.
Berlin has also written extensively on GHG issues. His reports, Global Warming and the Future of Coal, The Path to Carbon Capture and Storage and Early Deployment: Maximizing Carbon Capture and Storage Under the Warner Lieberman Global Warming Bill and several shorter analysis of clean coal were published in 2007 and 2008 by the Center for American Progress. His article, A Framework for Achieving Energy Security ahd Arresting Global Warming was published by the Center for American Progress in December 2008. His body of work also includes articles on a wide range of environment and resource issues, including international trade and environment, clean coal technology, hazardous waste cleanup, allocation of liability under environmental cleanup laws, property takings issues, environmental aspects of real estate transactions and corporate M&A, and endangered species.
